The purchase of products on the Romeogigli.it website is governed by these general conditions of sale (hereinafter referred to as the “General Conditions of Sale”), which you are requested to view before concluding a purchase order.

These General Conditions of Sale apply to all purchase orders made on the Romeogigli.it website according to the methods and terms indicated in the following point “How to conclude a purchase order”.

RECIPIENTS OF THE COMMERCIAL OFFER Romeogigli.it offers the products for sale to professionals. The conditions of sale refer to the provisions of the civil code and the regulations on distance selling by electronic means between professionals (B2B).

SUBJECT OF THE CONTRACT These General Conditions of Sale have as their object the purchase of fashion accessories, carried out remotely via the Internet between the seller and the recipient of the commercial offer.

PRODUCT PRICES All prices are inclusive of VAT.
Prices do not include shipping and/or insurance costs, which may however be viewed at the time of completing the order and before sending it. Prices may be modified at any time, without notice. The prices of products on sale on Romeogigli.it may be subject to updates and may differ depending on the country to which the relevant product is to be shipped. With reference to shipments to non-European countries, it is possible that some administrative charges, such as, for example, customs duties, cannot reasonably be calculated in advance; in this case, such administrative charges may still be charged to the customer. We therefore ask you to check the final price before completing a purchase order.

HOW TO PLACE A PURCHASE ORDER In order to place a purchase order on the Romeogigli.it website, the user must have a valid email address, as well as the legal requirements to enter into the relevant purchase contract. A purchase order can be placed by following this procedure: - After choosing one or more products to purchase, click on "Add to cart". - Fill out the order form following the instructions. The order form will indicate the essential characteristics of the products ordered, the relative price (including all taxes or duties, where determinable), the delivery costs, the payment and delivery methods for the products, an express link to the "Returns" section which indicates the methods, times and conditions for exercising the right of withdrawal and for returning the purchased products. - Before sending the order form, you will be asked to read the General Conditions of Sale and the Information on the right of withdrawal and to print and keep a copy for personal use. Please read carefully the provisions of these sections, as well as the "Privacy Policy" and "General Conditions of Sale" sections referred to via a specific link, because having transmitted the purchase order these provisions will be considered known and accepted in full. - Before transmitting the order form, you will also have the possibility of verifying the data entered in order to correct any errors. - At this point, to transmit the order form to Dalosrl.com, click on "Purchase". When Romeogigli.it receives the order form you sent, the purchase proposal will be considered submitted. - Following receipt of the order form, Romeogigli.it reserves the right to send an order receipt via email, which will contain the information already indicated in the order form (essential characteristics of the products, price, delivery costs, payment and delivery methods, link to the "Returns" section) and will proceed to execute the purchase order. - The order will be archived in the Romeogigli.it database and can be viewed at any time by accessing the "Account" by entering the data through the "Login" function. The purchase contract for one or more products will be considered concluded only when Romeogigli.it communicates to the customer that the relevant product has been shipped. Romeogigli.it reserves the right not to execute purchase orders with missing or incorrect data, or that do not provide a guarantee of solvency. In these cases, the user will be informed by email of the non-execution of the order and the related reasons. Romeogigli.it also reserves the right not to execute purchase orders if the products are, for any reason and even temporarily, unavailable. In this case, within 3 (three) days of receiving the order, Romeogigli.it will inform the user by email that the product is not available and will refund any amount already paid. If the products ordered are available and Romeogigli.it intends to accept the purchase order, Romeogigli.it undertakes to process the order and ship the products within 2 (two) days. Romeogigli.it is exempt from any liability for delays in the delivery of products that are independent of the conduct of Romeogigli.it, for example because they depend on the service provided by the courier who manages the delivery.

PAYMENTS The various payment methods for the price of the products and the related delivery costs are indicated in the order form. These methods include Credit Cards and PayPal, Bank Transfer and Cash on Delivery. The price indicated in the order form for the purchase of the products and for the related delivery costs will be charged to the customer once the purchase order has been completed. If the customer makes the payment by Credit Card, Romeogigli.it guarantees that the management of the payment procedure will be managed by a primary payment gateway without Romeogigli.it coming into possession of any banking or financial data. The credit card information will be used exclusively to be able to execute the purchase procedure, to credit the relative refund if the customer were to return the products by virtue of the right of withdrawal, or if it were necessary to report to the competent authorities any fraud committed on the Spizzicohome.it site, furthermore, under no circumstances will Romeogigli.it keep data regarding such information. If the customer makes the payment by Bank Transfer/Postal Advance, the order fulfillment procedure will be started once the amount of the entire order has been credited to the C/C in the name of Romeogigli.it (about 1-5 working days). The reason for the transfer must include: The date and number of the order - Name and surname of the person placing the order. Upon confirmation of the order, the customer will receive an email with all the details to make the transfer.

SHIPPING: TIMES AND DELIVERY Except in the case of partial or total unavailability of the products, in the event that Romeogigli.it decides to execute the purchase order, Romeogigli.it undertakes to deliver the product or products to the courier no later than 2 (two) days from the date of forwarding the purchase order. Accepted orders will be shipped and delivered via a courier selected by Dalosrl.com. To find out all the details on the shipping and delivery methods of the products, you must consult the "Delivery & Transport" section. You are invited to read the content of the "Delivery & Transport" section because it is an integral and substantial part of these General Conditions of Sale and, therefore, is considered to be known and accepted in full at the time of sending the order form. Romeogigli.it is exempt from any liability for delays in the delivery of the products that are independent of the conduct of Romeogigli.it, for example because they depend on the service provided by the courier who manages the delivery (e.g. strikes, etc.).

RIGHT OF WITHDRAWAL The customer who is a consumer has the right to withdraw from the purchase contract stipulated with Eccentric Srl without any penalty and without indicating the reasons. The withdrawal period expires after 14 (fourteen) days from the date on which the customer or a third party, other than the courier and the designated customer, acquires physical possession of the products.
In the event of withdrawal from this contract, all payments made will be refunded to the customer, including delivery costs (with the exception of additional costs resulting from the customer's choice of a type of delivery other than the standard one offered by Eccentric Srl), without undue delay and in any case no later than 14 (fourteen) days from the day on which Romeogigli.it receives the returned goods or the customer has unequivocally demonstrated that he has sent back the goods, depending on which situation occurs first. Returned products must be shipped to Romeogigli.it without undue delay and in any case within 14 (days) from the date on which the customer communicated to Romeogigli.it his intention to withdraw. The date of postal dispatch or delivery to the courier will be valid. The shipping costs of the returned products will be entirely borne by the customer. Refunds will be made using the same means of payment used for the initial transaction. The customer will be solely responsible for the decrease in value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products. It is specified that:

1. It is absolutely forbidden to remove seals or labels;
2. The products must be shipped healthy, clean, intact and complete, including any accessories;
3. It is forbidden to use the products for "test" purposes before returning them.
4. The right of withdrawal does not apply to sealed products opened by the consumer, nor to sealed goods that are not suitable for return for reasons of hygiene or related to health protection that have been opened after delivery.

The following are excluded from the right of return:

- Products made to measure or personalized: sheets, bags.

- Washed, used, dirty or damaged items.

In the event that the customer does not comply with the terms for the right of withdrawal and return indicated above, or the provisions set out in the previous points 1), 2), 3) and 4), Romeogigli.it will not be required to refund the purchase price of the products to the customer. In the event that the customer has returned such products, he/she may ask Romeogigli.it to resend the same purchased items, but with the return shipping costs entirely borne by the customer who has violated the rules on the right of withdrawal. Please consult the "Exchanges and Returns" section to find out further details on the methods, terms and conditions for exercising the right of withdrawal. Please remember that the content of the "Returns" section is an integral and substantial part of these General Conditions of Sale and is considered to be known and accepted in full by the customer at the time of sending the order form.

MODIFICATION OF THE GENERAL CONDITIONS OF SALE If it deems it necessary or appropriate, Romeogigli.it reserves the right to modify or update these General Conditions of Sale. We therefore invite you to periodically consult the section on the General Conditions of Sale and, in any case, to read it carefully before placing each order.

APPLICABLE LAW, JURISDICTION AND DISPUTE RESOLUTION The General Conditions of Sale are governed by Italian law, with particular reference to Legislative Decree no. 206 of 6 September 2005 (so-called “Consumer Code”) as amended by Legislative Decree no. 146 of 2 August 2007, by Legislative Decree no. 201/2011 converted, with amendments, by Law no. 214 of 22 December 2011, by Legislative Decree no. 1/2012 converted, with amendments, by Law no. 27 of 24 March 2012, and by Legislative Decree no. 21 of 21 February 2014, as well as Legislative Decree no. 70 of 9 April 2003 on electronic commerce, and by any other applicable legislation in force on the matter. According to article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can avail of the Joint Conciliation procedure. The Procedure can be started if the consumer, after having submitted a complaint to the company, within thirty days, has not received a response or has received a response that he does not consider satisfactory. In all other cases, territorial jurisdiction falls exclusively and indelibly to the Court of Bari. Romeogigli.it does not enter into contracts with minors under 18 years of age.

TRADEMARKS AND IMAGES Trademarks and images relating to third-party manufacturers used on this site do not belong to Romeogigli.it and are to be considered the exclusive property of their respective owners. Any reproduction of the same is to be considered prohibited. The images of the product packaging may differ in whole or in part from the originals.
